PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Alyve RX platform, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our Services.
Alyve RX is a technology platform that facilitates connections between patients and independent, licensed healthcare providers (“Physicians”). Alyve RX does not practice medicine and does not provide medical advice, diagnosis, or treatment.
All medical services, including physician consultations and the issuance of prescriptions, are provided solely by independent, licensed Physicians who are not employees or agents of Alyve RX. Alyve RX is not responsible for the medical decisions made by these independent providers.
To use our Services, you must:
Prescriptions are not guaranteed. The reviewing Physician will independently determine whether you are a candidate for any medication based solely on your health information and their professional medical judgment. Alyve RX has no influence over the Physician’s prescribing decisions.
Compounded medications offered through our platform are not FDA-approved. They are prepared by licensed compounding pharmacies pursuant to individual prescriptions. These compounded medications have not been evaluated by the Food and Drug Administration in the same manner as FDA-approved drug products.
These statements have not been evaluated by the Food and Drug Administration. Our products and services are not intended to diagnose, treat, cure, or prevent any disease.
You agree to provide accurate, current, and complete information in your intake form and in all communications with Physicians. Providing false or misleading health information is a serious health risk and may constitute fraud. Alyve RX and its affiliated Physicians are not liable for adverse outcomes resulting from inaccurate information provided by you.
Alyve RX is not an emergency medical service. If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. Do not use our platform for emergency medical situations.
Prescriptions issued by Physicians through our platform are fulfilled by independent, licensed compounding pharmacies. Alyve RX does not own, operate, or control these pharmacies. All compounded medications are prepared in accordance with applicable state and federal pharmacy laws.
Fees for our Services, including physician consultation fees and medication costs, are disclosed at the time of purchase. All fees are subject to change. Physician consultation fees may be charged regardless of whether a prescription is issued. We do not accept insurance.
Physician consultation fees are generally non-refundable once a physician review has been initiated. Medication refund requests are handled on a case-by-case basis in accordance with applicable pharmacy laws. Please contact us at support@alyverx.com for refund inquiries.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALYVE RX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO MEDICAL OUTCOMES, ADVERSE REACTIONS, OR PRESCRIPTION DECISIONS MADE BY INDEPENDENT PHYSICIANS.
You agree to indemnify and hold harmless Alyve RX and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our Services, your violation of these Terms, or your provision of inaccurate health information.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website with a revised effective date. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
